OPINION

KLINGEMAN, Justice.

This is a suit by Donoho & Sons, Inc., appellant here and plaintiff below, hereinafter called Donoho, against Aetna Insurance Company, appellee here and defendant below, hereinafter called Aetna, on a policy of insurance issued by Aetna to Floyd Bien-ek, dba Bienek Construction Co., as insured,1 to recover losses occasioned by theft from a house in the process of construction.
