1Per curiam

The indictment before us charges the defendant with having committed sodomy in violation of G. L. 1956, §11-10-1. Special pleas attacking the validity of the indictment were filed by the defendant. After a hearing, the pleas were denied and exceptions to the trial justice’s rulings were duly noted in behalf of the defendant. Within the time prescribed by statute, a bill of exceptions was filed 'by the defendant .and allowed by the trial justice. The papers were then certified to. this court and briefs were filed in behalf of the defendant and the state.
