The appellee, Tobacco Growers’ Association, commenced this action in the Grant circuit court against appellant, Rowland, a member, to recover five (5c) cents per pound as liquidated damages on 10,000 pounds of tobacco produced by appellant in 1922, which, it is alleged in the petition and admitted by appellant, was sold and delivered outside the pool in violation of the terms of the pool contract, and to recover $250.00 attorney fees and cost incurred in this litigation, which, it is averred, was made necessary by the wrongful conduct of…
