This was an action of replevin brought by Bourne, a Constable, against Hocker, a Deputy Sheriff of Madison county, for three slaves which the plaintiff, as Constable, had taken under several common law attachments against one James, to whom they belonged, but which the defendant as Sheriff, levied on and took out of the plaintiff’s possession under and by virtue of an execution, (fi.fa.,) against the said James, which had come to the hands of the Sheriff and was so endorsed by him before the attachments were levied or came to hand,, but on the same day.
