THIS MATTER comes before the Court upon the Motion to Dismiss Petition or for Relief from Automatic Stay (the “Motion”) filed by Brantley M. Adams, Sr., Martha Adams, Brantley M. Adams, Jr., Christine Scott Adams, and Matthew Wilson Adams (collectively, the “Minority Shareholders”). The Minority Shareholders argue that Greenwood Supply Company (“Debtor”) filed its Chapter 11 bankruptcy petition in bad faith in an attempt to avoid pending civil litigation in state court (the “State Court Action”) and, because of this bad faith filing, the Court should…
