Plaintiff Jerry B. Klein (“the Trustee”), the trustee for the liquidation of the business of JNT Investors, Inc. (“JNT”), brought this action to recover the value of certain of JNT’s assets allegedly transferred to defendant S. Wolfe Emmer (“Emmer”) by JNT through its founder and president, defendant Jay N. Tabatchnick (“Tabatchnick”), in two transactions.
