Appeal and cross appeal from an order of the Supreme Court, Erie County (Eugene M. Fahey, J.), entered January 11, 2005 in a personal injury action. The order, among other things, granted that part of defendants’ motion seeking summary judgment *1260dismissing the complaint to the extent that plaintiffs allege that they had actual notice of the allegedly dangerous condition on their property.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
