On January 18, 1991, the Thomaston-Upson County Office Building Authority filed a complaint against Savage and others under the Special Master Act, OCGA § 22-2-100 et seq., to condemn avigation easements necessary for the construction of an airport.

On January 19, the superior court entered an order appointing a special master to hear evidence on Friday, February 1, at 8:00 a.m., as to the fair market value of the property rights sought to be condemned, taking into consideration the consequential damages and consequential benefits to any property not taken.
