Plaintiff Kustom Signals, Inc. (“Kus-tom”) brought suit against Applied Concepts, Inc. and John L. Aker, alleging that they infringed its patent for a police traffic radar. Defendants denied infringement and claimed that the patent was invalid. The Court granted defendants’ summary judgment motion on Kustom’s claim of infringement and certified the ruling for appeal under Rule 54(b), Fed.R.Civ.P.
