Appeal from the District Court of the United States for the District of Delaware; Edward G. Bradford, Judge. Suit in admiralty for collision by Walter M. Ervin, master of the schooner Dorothy B. Barrett, against the steamship Texas, with the lug James McCaulley, impleaded. Decree against both vessels, and their claimants appeal.

McPHERSON, Circuit Judge.
This suit has to do with a collision on the Delaware river, atid at first was between the schooner Dorothy R. J Sarrett as libelant and the steamship Texas as respondent The collision occurred on December 20, 1906, in the daytime, a few minutes after 2 o’clock, but a fog was prevailing and this condition no doubt occasioned the disaster. The schooner was in tow of the tug James McCaulley, and the Texas afterwards brought in the tug under the fifty-ninth, rule (29 Sup. Ct. xlvi).
