McKINSTER, J.

—Defendant and appellant Philip Raymond Mejia appeals his conviction for torture, spousal rape, spousal abuse, and criminal threats. We reject his contention that the court should have conducted a hearing pursuant to People v. Marsden (1970) 2 Cal.3d 118 [84 Cal.Rptr. 156, 465 P.2d 44] based on defendant’s statements during a hearing on his request to represent himself. We also reject his contentions concerning the improper admission of evidence. We agree, however, that Penal Code section 654 1 requires remand for resentencing.
