On July 12, 2006, Plaintiff, Raymond Alex, Sr., was driving a company boom truck while in the course and scope of his employment as a structure carpenter for BNSF Railway Company. At approximately 8:00 p.m. on that date, Plaintiff was traveling in a southerly direction on North Eastern Avenue in Crowley on his way to a job site in Mermentau.
