Appeal from a judgment of the Municipal Court of the city of Syracuse in favor of the plaintiff for $292.28 damages, together with costs, entered upon a verdict of a jury.

This action was brought to recover damages for an alleged breach of contract. On or about March 28, 1907, the parties entered into a contract for the sale by the defendant, and purchase by the plaintiff, of a vacant lot on Hudson street, Syracuse, owned by the defendant, at the *630agreed price of $500. The plaintiff was to pay this amount in semi-annual payments of $50 each, beginning at the date of said contract, together with the interest and taxes.
