Appeal from an order of the Herkimer County Court (Patrick L. Kirk, J.), entered May 19, 2005. The order denied the motion of respondent Terry R. Jones seeking, inter aha, to vacate the default judgment in this tax foreclosure proceeding.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
