At Fall Term, 1866, of the Court of Equity for Beaufort county, upon the petition of the stockholders of the Bank of "Washington, there was a decree of that Court, vesting all the real and personal property and choses in action of the Bank of Washington in the plaintiff, as commissioner, pursuant to the act of the General Assembly, ratified March 12th, 1866, for the benefit of such of the creditors of said bank as proved their debts within twelve months.…

Panic of Charlotte v. Hart, et al. 67 N. C. Rep. 264, the right of the defendant to have “ the bills of the bank” applied in payment of a judgment in favor of the bank, is conceded; and the only question was, as to the allowance of interest upon the bills from the time at which the defendant had demanded to have the bills received in satisfaction of the judgment; it is decided that interest should be allowed.
