*261Defendant appeals a judgment of conviction for one count of failure to perform the duties of a driver to injured persons, ORS 811.705(2)(b) ; reckless driving, ORS 811.140 ; and recklessly endangering another person, ORS 163.195. The convictions arose from defendant's act of unsafe passing on Highway 6 in Tillamook County, an act that played a role in a fatal car accident.
