POPE, Justice.

R. E. Morrison, a former stockholder in The St. Anthony Hotel, has appealed from an order dismissing his suit against The St. Anthony Hotel, its directors, and the Pan American Hotel Company, which owned the majority of the stock of The St. Anthony. The trial court sustained a plea of res ju-dicata and a special exception which stated that plaintiff had failed to assert a cause of action.
