Four stockholders brought a mandamus action against the defendants, the Richards-Wilcox Manufactoring Company, its president and its secretary. The stockholders were three brothers, Richard, John and Thomas Wise, and their sister, Elizabeth Winger. Their complaint alleged that the defendants refused to permit them to examine the company’s books and records. After various pleadings had been filed, Elizabeth Winger moved for summary judgment.
