The single question on this appeal is whether the trial court is in error in sustaining the demurrer to an amended declaration, and, on the refusal of the plaintiff further to amend, in entering a judgment of non pros, against the plaintiff in favor of the defendant for costs. The plaintiff, Nathaniel Jackson, was injured on the night of the 29th of June, 1937, while walking on the railway-tracks of the defendant, The Pennsylvania Railroad Company, near a street crossing.
