Appellant, State of Nevada, Nevada State Purchasing Division (State Purchasing), awarded a contract to supply the Nevada Division of State Parks (State Parks) with a backhoe to a bidder who did not submit the lowest bid, and determined that the lowest bidder, respondent George’s Equipment Company, Inc. (George’s), did not meet all specifications in the bid it submitted and had not submitted a responsible bid because of the unreliability of its product.
