The beneficiaries of a trust and pour-over will filed a petition for an accounting and injunction against the decedent’s widow, Mary Boerckel, individually and as successor trustee under the Eldert W. Boerckel Irrevocable Trust. 1 The trial court dismissed the claims against Boerck-el individually with prejudice, without allowing petitioners leave to amend the petition. Petitioners’ proposed amendment was intended to clarify claims being asserted against Boerckel personally. Because the trial court abused its discretion in refusing to allow petitioners an opportunity to amend, we reverse.
