L.H. Marshburn, plaintiff in error, instituted suit in the district court of Tyler County, Texas, against Sidney Stewart and others, defendants in error, to recover 3873 acres of land, a part of the George T.W. Collins league situated in said county. The other plaintiffs in error claim under him. Reba A. Gaines and others, claimants of the remainder of said league, none of which was ever held or claimed by Cyrus S. Aiken, were made parties defendant in the suit.
