MURRAY, Justice.

This suit was instituted by the State of Texas, acting by and through its Attorney General, Hon. Gerald C. Mann, for and on behalf of the Public Free School Fund, against Indio Cattle Company, a corporation, J. D. Cage, Richard G. Cage, Robert C. Cage, J. M. West, J. Marion West, B. G. Barnes, Mrs. Ermin F. Barnes, Gus H. *310Krausse and a number of other defendants, seeking in a trespass to try title suit a recovery of 165,762 acres of land situated in Maverick, Webb and Dimmit Counties, Texas, and generally referred to as the Antonio Rivas Grant.
