Martin, J.

I cannot agree with the results of the majority opinion. I can agree that the only question in this appeal is the proper construction of Chapter 309 of the Acts of the General Assembly, approved March 15, 1913, and that this Act has not been construed by the higher courts of this state.

The legislature, in writing this law covering the subject of revocation of wills by subsequent marriage, divided wills into two classes, those which were executed by persons while they were married, and those executed by persons while they were unmarried. This law grants to persons…
