This is an appeal from a judgment rendered in the District Court in favor of appellee (hereinafter called plaintiff) and against the Mutual Life Insurance Company of New York appellant (hereinafter called defendant), for the sum of $23,458.-31. The action was upon two life insurance contracts upon the life of Charles W.
