This appeal involves an action brought by Donald Vandenberg, father, and administrator of the estate of Thomas Vandenberg, deceased, against the defendants, Irvin Langan, and his employee, Steve Greisen, for the wrongful death of Thomas Vandenberg when he fell or was thrown from a flatbed hayrack being pulled by a tractor owned by the defendant Langan and operated by the defendant Greisen. The court decided, as a matter of law, that the defendants were negligent, holding the decedent to be other than a guest at the time of the accident, and directed liability against them.
