Petitioner Richard McIntyre (“McIntyre”) brings this petition for writ of habe-as corpus pursuant to 28 U.S.C. § 2254. I referred the petition to the magistrate judge for a Report and Recommendation (“R & R”) in accordance with 28 U.S.C. § 636(b)(1)(B). The R & R, recommended that I deny the petition. McIntyre filed timely objections and respondent filed a response to those objections. McIntyre then sought and was granted permission to file a praecipe.
