The defendant, Joseph Paolella, was convicted after a trial to the court1 of kidnapping in the second degree with a firearm in violation of General Statutes § 53a-94a2 and assault in the third degree *674in violation of General Statutes § 53a-61 (a) (1).3 The trial court sentenced the defendant to fifteen years imprisonment on the kidnapping charge, suspended after eight years and five years probation.
