MEMORANDUM
BACKWATER, District Judge.
Presently before this Court is Defendant’s Motion to Dismiss or in the Alternative for Summary Judgment. As discussed below, Defendant’s motion is granted in its entirety.
I. STATEMENT OF FACTS
Kelly N. Pryor (“Pryor”) and Warren E. Spivey, Jr. (“Spivey”) (collectively “Plaintiffs”), filed claims against National Collegiate Athletic Association (“Defendant” or “NCAA”), alleging racial discrimination under Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000(d) and under 42 U.S.C. § 1981.
