MEMORANDUM OPINION
FACCIOLA, United States Magistrate Judge.
This case has been referred to me for resolution of Show Horse Support Fund, Inc.’s (the “Fund”) Motion to Intervene. For the reasons discussed below, the Motion to Intervene is granted.
I. BACKGROUND
This suit involves a challenge by a nonprofit organization to the legality of a particular Department of Agriculture program known as the “Horse Protection Operating Plan” (“Operating Plan”).
