Appeal by the defendant, William Jacobs, from an order of . the Supreme Court, made at the Richmond Special Term and entered in the office of the clerk of the county of Richmond on the 21st day of November, 1913, denying the appellant’s motion to compel the acceptance of his answer by the plaintiff herein.

Burr, J.:
On the 23d day of September, 1912, William Jacobs, a defendant in this action, was served with the summons and complaint. On the eighth of October in the same year and within the time requited for the service of an answer he obtained a written stipulation from plaintiff’s attorney that he should have “ until the 15th day of November, 1912, in which to answer the complaint ” therein. On the fifteenth of November he served a verified answer. On the same day it was returned by plaintiff’s attorney on the ground that it was not served in time.
