On this appeal each side is both appellant and appellee.

On March 18, 1941, the United Employers Casualty Company, a Texas corporation, was adjudged insolvent by a district court of Travis County, and Will G. Knox was appointed receiver. Prior to that, on July 20, 1938, said corporation had bought out all the assets, and assumed all the liabilities of the Southern Underwriters, also a Texas corporation. For reasons not apparent from the record, the latter-named corporation was also adjudged insolvent by the same court, and Will G. Knox was appointed receiver on February 19, 1942.…
