delivered the opinion of the court:

On November 17, 1971, Barry Wintersmith, hereafter called defendant, was convicted in the Circuit Court of Cook County of the crime of voluntary manslaughter. Defendant was charged by indictment with murder. After a conference, the State reduced the charge to voluntary manslaughter and the defendant entered a plea of guilty. The defendant was sentenced to a term of eight to fifteen years in the Illinois State Penitentiary.
