The plaintiff brought an action for interpleader in the Rutland Superior Court seeking guidance as to which of the various creditors of Garth Carter should be paid out of the judgment funds awarded Carter in Carter’s action against the plaintiff. The plaintiff had been found liable for breaching construction contracts for work done and materials furnished by Carter in connection with a development of the plaintiff’s near Sherburne Mountain.
