This matter was before the Court on September 11, 2001, for a combined hear ing pursuant to Fed.R.Civ.P. 65(a)(2) on Plaintiffs’ application for a preliminary injunction and a trial on the merits. Based on the arguments and memoranda of counsel, the evidence in the record, and the applicable law, the Court makes the following

FINDINGS OF FACT
