Walter B. West brought suit against James L. Bass. The plaintiff’s petition was, in substance, as follows: On July 23, 1898, petitioner was doing business in the name and style of the “West Cycle Company,” and was in possession of a storehouse and lot fronting on Broad street, in the city of Borne, which lot was joined on one side by a storehouse and lot owned by the defendant. Petitioner’s tenancy and right of possession does not expire until May i, 1899.
