Plaintiff, a mortgage creditor, proceeded to the •collection of his claim via executiva, and the property hypothecated was advertised for sale.
Some ten days prior to the sale, Thos. H. Sampson made himself a party to the proceedings by filing a petition of intervention and third opposition, and it is with him alone that plaintiff has to deal in ¡this controversy.
