This is an action of assumpsit brought by Kendrick against Williams. The declaration contains three counts, the second of which is not relied upon. The first consists of the general counts in assumpsit; and the third states the special contract upon which the plaintiff expects to recover, .and sets forth that the plaintiff and defendant agreed to obtain, through one Hubert Raven, an option contract from the Clinch Valley Coal and Iron Company for the purchase of certain real estate on Indian Creek in Tazewell county, and it was agreed that if a…
