Appellee sued appellant to recover damages alleged to have been sustained by him on account of the loss of his leg as a result of the negligence of appellant in not using reasonable diligence to provide him with proper medical and surgical attention after he had received an accidental injury resulting in the fracture of the knee-cap of said leg.
