This matter is before the Court on cross-motions for summary judgment [DN 38, DN 39]. Fully briefed, this matter is ripe for decision.
I. BACKGROUND
Petitioners, Charles Fulkerson and Cindy Fulkerson, t/a Whittaker Shooting Supply, Inc., seek review of the denial of a Federal Firearm License (“FFL”) to Whittaker Shooting Supply by the Bureau of Alcohol, Tobacco, Firearms and Explosives (“ATF”).
