STEVENS, District Judge.

Before the Court is an appeal from a Memorandum Opinion of the Bankruptcy Court that granted defendant’s motion to dismiss plaintiffs complaint. In dismissing the complaint, the Bankruptcy Court held that a motorboat was not a “motor vehicle” within the meaning of 11 U.S.C. § 523(a)(9), which excepts from discharge in bankruptcy the debtor’s liabilities for death and personal injury caused by the debtor’s unlawful operation of a motor vehicle while under the influence of drugs or alcohol.
