MANTON, Circuit Judge.
The plaintiff in error conducts tours and cruises to various parts of the globe. It conducted a Mediterranean cruise in the late winter and spring of 1923 on the ship Rotterdam, and contracted with the defendant in error that for $4,800 he and his wife were entitled to all the pleasures, comforts, and benefits of the cruise. They were entitled to board, lodging, transportation, and service of cruise managers and guides. A certificate of membership in this cruise was issued to him.
