DAVIDSON, Judge.

Appellant was convicted of perjury, and was given two years in the penitentiary.

The indictment charges the perjury as having been committed before the grand jury. It is alleged that it was material inquiry before that body whether appellant bet at a game played with dice “with Claude Day, Jeff Dickson and others on a branch near the home of defendant on or about the 4th day of December, 1911.” That appellant testified in substance and in effect that “he did not bet at a game played with dice with Claude Day, Jeff Dickson or any other person, on the branch near his home in…
