Appeal by the plaintiff, Adelia Duane Ireland, from a judgment ’ of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 27th day of January, 1902, upon the verdict of a jury rendered by direction of the court, and also from an order entered in said clerk’s office on the 31st day of January, 1902, denying the plaintiff’s motion for a new trial made upon the minutes.

The facts in this case were not disputed. The plaintiff, being the owner of certain property upon Fifth avenue in the city of New York, by a lease dated April 1, 1886, leased the premises to one •Richard de Logerot for twenty-one years and nineteen days from the 12th day of April, 1886, the term ending on the 1st day of May, 1907, at the yearly rent of $23,000, payable in equal quarterly payments on the first days of October, January, April and July in each year; the tenant to pay all taxes and assessments and also to make certain alterations and improvements in the building upon…
