This was an appeal from a judgment for plaintiff in the Circuit Court of St. Charles County to the St. Louis Court of Appeals. There the judgment was affirmed, but the St. Louis Court of Appeals, deeming its opinion to be in conflict with the opinion of the Kansas City Court of Appeals in Weaver v. Woodling, 272 S. W. 373, certified the cause to this court. After a careful consideration of this case and of the opinions rendered in both cases we are satisfied that the doctrine announced in the opinion rendered in Weaver v. Woodling, should no longer be followed. We approve the well reasoned…
