Cullen, J.:
The first appeal before us is from an order of the Special Term denying a motion to 'quash a writ of alternative mandamus. In July, 1895, an application was made to the court on notice to Isaac M. Marsh and others, commissioners, for the issue of a writ of alternative mandamus. This application was opposed. On the sixteenth day of November an order was made, by the court granting the alternative.writ, and permitting the relator,.within forty days, to amend her petition as she might be advised.
