Appellant and plaintiff below, J. S. Maxwell, operates a real estate agency in the city of Lexington which he conducts in the trade-name of Maxwell Realty Company. Appellees and defendants below, George W. Bates and wife, owned a residence in the city of Lexington and the lot upon which it was situated.
