Petitioner Don V. McWilliams, a licensed real estate broker doing business as Al-Co Properties, Inc., commenced this CPLR article 78 proceeding to review a determination of the Department of State that he demonstrated *89untrustworthiness and incompetency (see Real Property Law, § 441-c) and that a provision of the “Broker-Salesman Contract” used by Al-Co governing the payment of listing commissions is improper and must be discontinued.
