This cause was before this court upon a former appeal,Hinckley Estate Co. v. Gurry, 53 Idaho 551, 26 P.2d 121, where a full statement of all the material facts will be found.

There is no contest on the foreclosure of the mortgage, the controversy being limited to the right of respondent, who by assignment from the original mortgagee became the owner and holder of the note and mortgage, to a deficiency judgment against appellant.
