This matter comes before the court on the additional defendants’ preliminary objections in the nature of a demurrer to the complaint. The basis of the demurrer *65stems from the additional defendants contention that a borough volunteer fire department under 42 Pa. C.S.A. §8541 is immune from liability. This section reads in part as follows:

“Except as otherwise provided in this subchapter, no local agency shall be liable for any damages on account of any injury to a person or property caused by any act of the local agency. ...”
